Important: This is a legal agreement. By accessing the Site or using our services—including daily wellness calls, check‑ins, and text notifications—you agree to these Terms. If you do not agree, do not use the Site or services.
1. Who We Are
Caregiver Help Team provides scheduled check‑in calls for seniors and text updates to designated caregivers or family members (the “Services”). We are not a medical provider, emergency service, or replacement for 911.
Emergency Disclaimer: If you believe anyone is in danger or experiencing a medical emergency, call 911 or your local emergency number immediately.
2. Eligibility & Accounts
- You must be at least 18 to create an account, purchase a package, or designate recipients of notifications.
- If you enroll a senior or another person, you represent that you have all necessary permissions and lawful authority to provide their information and consent on their behalf.
- You are responsible for keeping account credentials confidential and for all activity under your account.
3. Service Description
- We place scheduled wellness calls (typically morning, afternoon, and evening) to the enrolled person to ask non‑diagnostic well‑being questions (e.g., meals, medication, mood).
- When a concern is identified, we send text alerts or other notifications to designated contacts according to your settings.
- We may attempt escalations (e.g., additional calls to the senior and/or contacts) per your plan configuration.
- We do not dispatch emergency services, provide medical advice, or monitor in real time. Services depend on call connectivity, user responses, device/network availability, and accurate contact information you provide.
- No guarantee of outcomes. The Services are supportive and informational only and cannot prevent incidents, injury, or harm.
4. Not Medical Care; No Professional Advice
- We do not provide medical, nursing, psychological, legal, or financial advice.
- Information from our calls and notifications is not a diagnosis or treatment plan. Consult qualified professionals for any medical or legal questions.
5. Subscriptions, Billing & Refunds
- Some Services are offered on a subscription basis (“Plan”). By starting a Plan, you authorize us and/or our payment processor to charge the payment method on file for recurring fees, taxes, and any add‑ons.
- Renewals. Plans automatically renew for the billing period shown at checkout unless canceled prior to renewal.
- Cancellations. You may cancel at any time effective at the end of the current billing cycle via your account or by contacting us (see §18).
- Refunds. Except where required by law or expressly stated at purchase, fees are non‑refundable.
- Price Changes. We may modify prices or features on renewal with prior notice.
6. Trials & Promotions
- Trial or promotional offers are subject to the terms displayed at sign‑up. After the trial, regular billing begins unless you cancel before the trial ends.
- We may suspend, modify, or end promotions at any time.
7. User Responsibilities
- Provide accurate enrollment details (names, phone numbers, time windows, medication reminders, etc.) and keep them current.
- Ensure designated contacts consent to receive notifications.
- Do not use the Services for unlawful, harmful, or abusive purposes.
- You will not resell, reverse engineer, or misuse the Services or Site.
8. Communications & Text Messaging
- By providing phone numbers, you consent to receive calls and SMS/text messages related to the Services (e.g., wellness calls, alerts, account notices). Message and data rates may apply.
- You may opt out of non‑essential marketing messages; however, you may continue to receive essential service and account communications.
9. Privacy
- Our collection and use of personal information are described in our Privacy Policy (see §18 to request a copy or link).
- Do not share sensitive health or financial information beyond what is necessary for the Services. Where applicable, we implement reasonable safeguards but cannot guarantee absolute security.
10. Consent & Third‑Party Rights
- If you enroll another person, you represent that: (a) you are authorized to do so; (b) they consent to receive calls; and (c) their designated contacts consent to receive alerts.
- You are solely responsible for notifying all involved parties and obtaining required permissions.
11. Service Availability
- The Services may be unavailable for maintenance, outages, carrier issues, or events beyond our control.
- We may suspend or modify the Services (or components) with or without notice where reasonably necessary.
12. Intellectual Property
- The Site, trademarks, logos, text, graphics, and software are owned by us or our licensors and are protected by law.
- You receive a limited, revocable license to access and use the Site and Services for personal, non‑commercial purposes in accordance with these Terms.
13. Feedback
- If you submit feedback, ideas, or suggestions, you grant us a non‑exclusive, worldwide, royalty‑free, perpetual license to use them without any obligation to you.
14. Third‑Party Services
- We may integrate or rely on third‑party carriers, communication platforms, or payment processors. Your use of those services may be subject to their terms and privacy policies.
15. Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, GOODWILL; OR PERSONAL INJURY/PROPERTY DAMAGE ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
17. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms; (c) information you provide; or (d) your failure to obtain any required consents.

We make no representation that the Services are appropriate or available in all locations. You are responsible for compliance with local laws.
24. Contact Permissions & Recording (If Applicable)
- You authorize us to place calls to the enrolled person within chosen time windows.
- Where permitted by law and disclosed, calls may be recorded for quality and training.
- You will inform all participants that calls may be recorded or monitored where required.
25. SMS Short Code Terms (If Applicable)
- Frequency of messages varies by plan and user activity.
- Message and data rates may apply.
- Reply STOP to cancel non‑essential texts; reply HELP for help.
26. Service‑Specific Rules (Examples)
- Missed‑Call Handling: We may leave voicemails or attempt follow‑ups per plan settings.
- Escalation Ladder: You may configure the order and timing of contacts; we are not responsible for unreachable contacts or incorrect numbers.
- Quiet Hours: You may set quiet hours to limit non‑urgent communications; emergencies should be directed to 911.
27. Children’s Privacy
The Services are not directed to children under 13. Do not provide information about a child without lawful authority and consent where required.
